SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW. 10. Dispute Resolution
10.1 Informal Resolution

We will use reasonable efforts to resolve your concern within thirty (30) days of receiving your written complaint. If a satisfactory resolution is not reached within that period, either party may proceed to formal dispute resolution as provided below.
10.2 Binding Arbitration
EXCEPT AS SET FORTH IN SECTION 10.4, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, OR THE SERVICES, INCLUDING ANY QUESTION REGARDING THE EXISTENCE, VALIDITY, OR TERMINATION OF THESE TERMS, SHALL BE RESOLVED EXCLUSIVELY BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, WHICH ARE AVAILABLE AT WWW.ADR.ORG.
The arbitration shall be conducted in the English language and shall take place in the state where Dewey's Pizza maintains its principal place of business, or via telephone or video conference at the mutual agreement of the parties. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
10.3 Class Action Waiver
YOU AND DEWEY'S PIZZA AGREE THAT ANY ARBITRATION OR OTHER LEGAL PROCEEDING SHALL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. IF THIS WAIVER IS FOUND TO BE UNENFORCEABLE, THE ENTIRETY OF THE ARBITRATION PROVISION IN SECTION 10.2 SHALL BE NULL AND VOID.
10.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or to prevent imminent harm that cannot be adequately remedied by monetary damages. Claims within the jurisdictional limit of small claims courts may also be brought in small claims court.
11. Term and Termination
